Mr. ZHAO Yan joined Dentons Zhengzhou office in 2010, and acquired the Lawyer’s Practicing Certificate in 2013. He joined Blossom & Credit in January 2023 to practice at Blossom & Credit Zhengzhou office. His efforts mainly cover government legal affairs, administrative litigation, civil and commercial dispute resolution, corporate governance, financial and insurance, etc. During his practicing career, Mr. ZHAO Yan provided quality and efficient legal services for tens of government authorities, enterprises, and public institutions, including Zhengzhou Erqi District People’s Government, Zhengzhou Erqi Bureau of Finance, and Wulibao Sub-district Office of Erqi District, Zhengzhou City.
When providing legal services for the People’s Government of Erqi District, Zhengzhou City and the subordinate bureaus, commissions, and relocation command department thereof, Mr. ZHAO actively participated in major administrative decision-making, administrative litigation, complaint of citizens, efforts for social stability, popularization of legal knowledge, and other stages to provide the district government, offices, and other authorities with quality and efficient legal services, which was praised by the district government, the Bureau of Finance, and the offices. After winning the title of Outstanding Legal Advisor from the People’s Government of Erqi District, Zhengzhou City for three consecutive years in 2019, 2020, and 2021, Mr. ZHAO was engaged as a legal advisor to the People’s Government of Erqi District, Zhengzhou City for 2022.
1. With respect to major administrative decision-making by the government, Mr. ZHAO Yan accompanied leaders of Erqi District to visit Guangzhou City, and participated in the whole process of the negotiation and contracting between the People’s Government of Erqi District, Zhengzhou City and X Fund Investment Group on financing matters of the X project, hence successfully attracting investment for the relocation project of X real estate company and completing delivery of the project; participated in the drafting and finalization of the relocation plan for villagers of Wulibao Sub-district Office of Erqi District, Zhengzhou City to successfully relocate hundreds of villagers; participated in the reasoning for replacing the bankruptcy manager of an improvement project of settlements in a new village of Erqi District, Zhengzhou City and the restructuring procedure in substantial bankruptcy, and submitted legal opinions for leaders of the district, all of which opinions were adopted to achieve the objective of replacing the bankruptcy manager.
2. With respect to administrative litigation, Mr. ZHAO Yan won all the tens of administrative cases involving the People’s Government of Erqi District, Zhengzhou City, which maintained the lowest losing rate in administrative cases for Wulibao Sub-district Office of Erqi District, Zhengzhou City. Some of such administrative cases as listed as follows:
(1) Administrative litigation for dispute of relocation between GUO and the People’s Government of Erqi District, Zhengzhou City;
(2) Administrative litigation for dispute over fulfillment of administrative agreement between Henan X Textile Co., Ltd. and the People’s Government of Erqi District, Zhengzhou City;
(3) Administrative litigation for dispute over failure in performing administrative agreement initiated by WU against the People’s Government of Erqi District, Zhengzhou City and the Enhancement Command Department of Heyi Zone, Erqi District, Zhengzhou City;
(4) Administrative litigation for dispute over fulfillment of administrative agreement between SHANG and the People’s Government of Erqi District, Zhengzhou City, with Henan X Real Estate Co., Ltd. as the third person;
(5) Administrative litigation for confirmation of administrative act in violation of law between LIU and the People’s Government of Erqi District, Zhengzhou City;
(6) Administrative litigation for invalidation of the housing delivery announcement between ZHANG et. al. and the People’s Government of Erqi District, Zhengzhou City;
(7) Administrative litigation for invalidation of the housing delivery announcement between MA and the People’s Government of Erqi District, Zhengzhou City;
(8) Administrative litigation for declaration of withdrawing seal invalidation between the Owner Committee of a community in Zhengzhou City and Wulibao Sub-district Office of Erqi District, Zhengzhou City.
The winning of the cases above effectively supported the demolition and relocation efforts of the district government, and achieved the fundamental requirements of stability for the grass-roots.
3. With respect to complaint of citizens and efforts for social stability, when providing services for Wulibao Sub-district Office of Erqi District, Zhengzhou City, Mr. ZHAO Yan cooperated with the office to successfully address the problems complained for years by the complainants, and submitted legal opinions to the office on maintaining social stability in handling complaints, hence maintaining stability of complaint efforts at the grass-roots government.
